These Terms & Conditions (“Terms”) govern your use of elmflooringremodeling.com (the “Site”), operated by Elm Flooring & Remodeling (“Elm Flooring & Remodeling,” “we,” “us” or “our”), 6224 Spring Cypress Rd, Suite 116, Spring, TX 77379. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

SMS Terms of Service

1. Program description: Elm Flooring & Remodeling sends text messages about estimate requests, appointment confirmations and reminders, and project updates; and, only to those who opted in to marketing, special offers, promotions and remodeling tips.
2. How to opt out: reply STOP to any message. You’ll receive one confirmation and no further messages. To rejoin, submit the form again with consent checked.

4. Frequency: message frequency varies.
5. Rates: message and data rates may apply.
6. Carrier liability: carriers are not liable for delayed or undelivered messages.

Consent to receive text messages is optional and is not a condition of requesting an estimate or purchasing any service.

Use of the Site

You may use the Site to learn about our services and request an estimate. You agree not to misuse the Site, including by submitting false information, attempting to disrupt it, or using automated tools to scrape or submit forms.

Estimates are not contracts

Information on the Site, estimate requests, and any estimate, price or schedule discussed before a written agreement is signed are not a binding contract or offer. Work is performed only under a written agreement signed by you and Elm Flooring & Remodeling, and that agreement’s terms control.

Photos and content

Project photos on the Site show work by Elm Flooring & Remodeling. Results vary with each home, its condition and the materials chosen. All content on the Site — including text, photos, logos and design — belongs to Elm Flooring & Remodeling or is used with permission, and may not be copied or reused without our written consent.

Third-party links

The Site links to third-party sites, such as our financing provider. We are not responsible for their content or practices. Financing is offered and approved by the lender, not by Elm Flooring & Remodeling.

Disclaimer and limitation of liability

The Site is provided “as is.” To the fullest extent permitted by law, Elm Flooring & Remodeling disclaims all warranties regarding the Site and is not liable for any indirect, incidental or consequential damages arising from your use of the Site. Nothing in these Terms limits any warranty or obligation contained in a signed project agreement.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Harris County, Texas.

Changes

We may update these Terms from time to time. The “Last updated” date above shows when they last changed.
